(1)        INTRODUCTION

The Federal Government of Nigeria has earmarked funds for the execution of CAPITAL PROJECTS under the 2024 Appropriation Act. Consequently, the Agency is inviting Expression of Interest (EOI) for Consultancy Services as well as Technical and Financial Proposals from competent Firms/Contractors for the following programmes:

(1) REQUIREMENTS FOR EOI

(a)        Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including Form CAC 1.1 or CAC2 and CAC7. Business Name with Form BN1 is also acceptable for Services;

(b)        Memorandum and Articles of Association

(c)        Evidence of Company Income’s Tax Clearance Certificate (or Personal Income Tax Clearance Certificate of all Partners in case of Business Name) for the last three (3) years valid till 31st December, 2024;

(d)        Evidence of Pension Clearance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above);

(e)         Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);

(f)         Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2024;

(g)        Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2024 or valid Certificate issued by BPP.

(h)        Sworn Affidavit:

·        disclosing whether or not any officer of the relevant committees of the Small & Medium Enterprises Development Agency of Nigeria or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;

·        that no Director has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter;

·        that the Company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petition or proceedings;

·        that the company does not have existing loan or financial liability with a bank, other financial institution or third party that is classified as doubtful, nonperformance, bad or whose repayment portion has been outstanding for the last four (4) months.

(i)            Evidence of Original Equipment Manufacturer (OEM)/Representative for the procurement of equipment;

(j)            Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/ Professional qualifications;

(k)          For ICT projects: Evidence of Firm’s current registration/accreditation with Computer Professionals Registration Council of Nigeria and National Information Technology Development Agency (NITDA);

(l)    For Training: Evidence of accreditation by Centre for Management Development (CMD) or certified Business Development Service Provider (BDSP).

Note: All profiles must be bonded with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC), Contact Address, Mobile Telephone Number, and e-mail address. The Letterhead Paper must bear the Names, Phone Numbers and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.

(2)  SUBMISSION OF EOI

One (1) copy of spiral bound pre-qualification documents should be sealed in an envelope and clearly marked “Expression of Interest”. The name of the company, programme and Lot number should be boldly written on the reverse side of the envelope and should be dropped in a box at the Procurement Unit Office located on the first floor, SMEDAN New Corporate Headquarters, Idu Abuja. The closing date for the submission is 12:00 noon on Monday, 15 April, 2024. No Payment is required for EOI.

(3)    OPENING OFEOI

The EOIs will be opened immediately after the deadline for submission at 12:00 noon on Monday, 15 April, 2024, in the presence of applicants or their representatives. Please, ensure that you sign the EOI Submission Register as the SMEDAN will not be held liable for misplaced or wrongly submitted bids.

(4) ADDITIONAL INFORMATION

(i)         No Company/Firm should bid for more than two (2) Lots;

(ii)        The EOIs will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies; and will be covered by video recording; invitation link will be sent to bidder who chooses to join the EOI’s opening online;

(iii)       Only Shortlisted firms at EOI’s evaluation will be invited at a later date for collection of Request for Proposal.

(iv)       Late submission will be returned unopened.

(v)        Applicants shall be responsible for all expenses incurred in the preparation of their Bids.

(vi)       Failure to satisfactorily fulfill the conditions as requested above will result to the invalidation of such EOI.

(vii)      SMEDAN reserves the right to verify the authenticity of claim(s) made by any applicant.

(viii)     SMEDAN shall reserve the right to disqualify any submission based on unverifiable Information.

(ix)       Please note that this exercise places no commitment on SMEDAN nor establishes any legal relationship whatsoever.

(x)        The SMEDAN is not bound to prequalify/ shortlist any bidder and reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with section 28 of the Public Procurement Act 2007.
